myfirsttractor.com website (the "Website") is owned and operated by Tincknell Ltd. All of the goods on this Website are offered by Tincknell Ltd ("we/us") which will be the contracting party for any order that you place.

These Terms and Conditions of Sale apply to all transactions for the sale of goods on the Website. Please read them carefully. They do not affect your statutory rights.
We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Website.

2. Pricing and promotions

Although we endeavor to ensure that all pricing information on the Website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
These Terms & Conditions are supplemental to any additional terms that might apply to specific transactions.
Prices that are reduced for sales and promotions are only valid for the specified period.
We reserve the right to adjust prices, offers, goods and specifications of goods on the Website at our discretion at any time before (but not after) we accept your order.
All prices on the My First Tractor website are in UK Pounds Sterling and include VAT, where relevant, at the current UK VAT rate.

3. Placing an order

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these terms and condition, then you should contact one of our customer service advisors before placing an order with us either by email at: info@myfirsttractor.com or by post using the address given below.
By placing an order via this website you are making an offer to Tincknell Ltd to purchase the goods detailed in your order upon the terms described in your order.
Once you have placed an order we will and payment is authorised you will be taken to a page that have your unique order reference number and indicates an order has been received but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Tincknell Ltd for the sale of our products will only exist once an order has been accepted, processed and despatched to you.
Prices and availability of goods are subject to change without notice.

4. Your right to cancel

You may normally cancel your order (once accepted by us) for any reason up to the point of despatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days.
Please note that it is not possible to cancel an order for personalised items if the work has already been done for you.

5. Returns Policy

We endeavour to provide the best Customer Service possible. Should anything go wrong, we will make every effort to resolve the issue. However, should the problem be unsolvable, or you prefer to amend or Cancel your Order, please contact info@myfirsttractor.com

You may Cancel your Order within 7 days from the date of making the Order for any reason. If you Cancel your Order via telephone your Order will be put on hold. You must confirm your wish to Cancel the Order in writing via email or post within 7 working days. Your Order will not be considered Cancelled until notification in writing is received.

If you decide to Cancel an Order after the Products have been despatched and commenced their carriage to you by carrier or post, we may charge you for the carriage of those Products. We advise you check the status of the Order before you request Cancellation. Any charges will be communicated to you before we confirm the Cancellation.

You are entitled to Cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on your behalf or as your agent and be re-credited by us to the extent that such sums are not reimbursed by the card issuer.

5. Returns

Before you request or arrange return of a Product, please read the below information carefully. Contact us to arrange a Return and request a Return Acknowledgment Number.

If You are Returning a Product for any reason, except damage or manufacturer defect, You must pay the costs of Returning the Products to Us or our suppliers. On request, we will collect the Products from you, but the cost of this will be charged to you and we may deduct this from the Refund.

If:

� the Product delivered is not what you Ordered (including an unapproved Substitute Product), or does not correspond with its description;

� the Product delivered is not of a satisfactory quality,

� the Product arrives damaged or faulty

And you have notified us within 7 working days, we may replace the item or affected parts or you may Cancel the Order and receive a full Refund. You will not be charged for the costs of returning an unapproved substitute or defective product.

If Products arrive in a damaged condition you must make a note on the carrier's Delivery consignment note where possible and inform us within 7 working days of the Delivery.

If the Product becomes defective soon after 7 working days have passed, R Tincknell & Son (Agricultural) Ltd will, at its option, repair the product, replace the Product or Refund you. You will not be charged for the cost of Returning a defective Product.

We will not accept Returns or Cancellations if the Products have been altered by applying chemicals or paints to the surfaces or by altering or customising the Product in any way that could be deemed as you using or treating the Products as your own.

While in your possession, you must keep any Products you intend to Return to us in good condition. Products must be Returned in the same condition as they were delivered. If products were delivered flat packed they must be Returned in the same way. Care must be taken to ensure the Return Products are packed well to avoid damage or loss of parts in transit.

Products Returned which cannot be re-sold as new due to damage or wear and tear may be subject to a reduction in the Refund given.

Contact us to arrange a Return and request a Return Acknowledgement Number.

6. Conformity of Goods

We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.

7. Disclaimer & limitations of liability

Tincknell Ltd does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation.
To the fullest extent permitted by law and save as provided above, neither Tincknell Ltd nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Tincknell Ltd or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.
The limitations of liability in these conditions shall apply equally for the benefit of Tincknell Ltd and any other associated company of Tincknell Ltd as if references to Tincknell Ltd included references to each such associated company.
While Tincknell Ltd uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Tincknell Ltd will not be responsible for any errors or omissions or for the results arising from the use of such information.
While Tincknell Ltd takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

Accordingly, any products or promotions not permitted under your local law are not offered to you.
